Judicial decisions to pay the sperm donor support
The Pennsylvania Superior Court, in a recent decision has ordered a sperm donor, had a close relationship with whom he had two children must pay child.
It is an interesting decision for a number of reasons.
First, the PA has no laws, address reproductive issues like this, which led to a first ruling, which identifies three adults and parents and financial responsibilities for same children.
In addition, the anonymous sperm donor, but a friend of the biological mother, and he finally tried partially custody for children.
To complicate matters further, the donor is deceased during the judicial process was underway.
Both children were born, Jodilynn Jacob, 33 at the time was in a long-term relationship with another woman, Jennifer Lee Shultz-Jacob, 48 women began living together in 1996 in York County.
Ms. Jacob was a friend of Carl L. Frampton Jr., Indiana, Pennsylvania, and he agreed semen to understand them.
Once children born, Mr. Frampton was a big factor in their lives. It’s his money, bought toys and clothes, save and even a credit for women to buy a car.
The children called the “Papa”.
But in February 2006, the two women separated from each other.
Ms. Jacob, now lives in Harrisburg, entered the action to support a child against Ms. Shultz-Jacob in Dauphin County. A judge has ordered the care, Ms. Jacob Shultz appeal and calls for specific action that the biological father would have had to pay for children, to whom the amount owed.
A Dauphin County judge did not agree and do not propose that man from Indiana County to pay support.
At the same time, York County, a judge M. Frampton partially custody for children. He received for a weekend per month.
In the April 30 Superior Court decision of Mr system of care to pay Frampton, the three judges found that “voluntary, even enthusiasm, an integral part of their lives.
Attorney John window composers, representing the biological father in case of support, said the money was not an issue.
“There was support,” said window dishonest. “Carl’s perspective, it has never been for money.”
The most interesting part of the case, Mr component is said, is that in its judgement, the Superior Court, three people are financially responsible for children.
“The jurisprudence in Pennsylvania [before] said, it has only two parents,” he said. “This is the first case, identify three people.”
The Dauphin County Court that for the first time where, at least three people with financial responsibility was untenable situation. But the Superior Court disagreed and said: “We are not convinced that the calculation of support orders is not new.
