Parents organize the fight to reform federal laws child custody
John Cihon lost custody of 6 years, Andrew, as he and his wife divorced. Now, father and son spend two weekends per month and try to lecture on the phone almost every day.
“I hate,” says Cihon of limiting contact. “He asks me all the time,” When do I come? When can I see you? ”
Cihon, Pittsburgh, contributes to about 25 million parents in USA - 22 million fathers and mothers of 3 million - are just as it does not live with their children because of unfair laws, custody.
Last week, Cihon was part of a national effort to reform these statues, as a plaintiff, if it lead to federal action against the State of Pennsylvania.
The leadership of the Indiana Civil Rights Council, the same groups such as the American Coalition for Fathers and Children plan to accuse all 50 U.S. states and territories. At least 40 complaints were filed after the Council.
The appeals use of a wide range of constitutional grounds, to discuss a child’s natural parents both have the same right to custody, but good for one parent is too often trumped by a swell legal retentissants unclear, but sufficiently known as the “best interest of the child.”
In general is in favour of children and family lawyers say, the courts found in the well-being of the child to physical custody of the person providing primary care. Living with a parent of a child reduces shuttling - before a young - between houses. The noncustodial parent is usually the main breadwinner, often, man, spends more time away from the child.
“When the progress of children (time), they are better able to the situation, with these types of situations,” said Chris Zawisza, director of the defence of the child to the hospital in Memphis University Law School.
Appeals must be $ 1 million for any damage he may be a collective action on different meaning that the potential damage in the billions of Germany. But what the groups really want are changes in laws, such as a proposed bill through the State of Pennsylvania Rep. Thomas Stevenson.
Stevenson’s law would be a “provisional standard” that physical custody of 50-50 should be separated, unless a parent can prove that this is a good basis for another term. Notices custody, which allows both parents a say on issues such as religion, health and education, can be shared equally, although physical custody.
